GENERAL TERMS AND CONDITIONS FOR TOURISM SERVICES ANDEAN MOMENTS PERU E.I.R.L.

1. INTRODUCTION AND GENERAL OVERVIEW

This document sets forth the Terms and Conditions Agreement (hereinafter referred to as the “CONTRACT”) governing the contractual relationship between ANDEAN MOMENTS PERU E.I.R.L. (hereinafter “THE AGENCY” or “THE COMPANY”), identified with Tax ID (RUC) No. 20615685926, with registered legal address at PROLONGACION TUPAC AMARU S/N SAN JERONIMO, CUSCO, CUSCO; and the individual or legal entity purchasing travel services (hereinafter “THE CLIENT” or “THE PASSENGER”).

Access to the website https://andeanmoments.com/, requests for quotes, inquiries, and booking confirmations made via email, web forms, social media, or WhatsApp at 952160463, imply the full, absolute, and unconditional acceptance of every clause contained in this document.

If THE CLIENT does not agree with these terms and conditions, they must refrain from using the services offered by THE AGENCY.

2. DEFINITIONS

For the purposes of interpreting this contract, the following definitions are established:

THE AGENCY: ANDEAN MOMENTS PERU E.I.R.L., acting as an intermediary for travel services within Peruvian territory.

THE CLIENT: The individual or legal entity that contracts, requests, or pays for the travel services offered by THE AGENCY.

THE PASSENGER: The person who actually travels or enjoys the contracted travel service, who may or may not be the same person as THE CLIENT who made the reservation.

NO SHOW: A situation in which THE PASSENGER fails to arrive at the established place, date, and time for the start of the service without prior formal cancellation.

FORCE MAJEURE: Extraordinary, unforeseeable, and unavoidable events that prevent the normal execution of the service, including natural disasters, strikes, roadblocks, social unrest, health emergencies, extreme weather, or other situations beyond THE AGENCY’s control.

EXTERNAL PROVIDERS: Independent companies or entities involved in providing complementary travel services, such as hotels, airlines, rail companies, restaurants, transport operators, and authorized guides.

3. BOOKING AND CONTRACTING PROCESS

3.1 Inquiries and Quotes Information published on THE AGENCY’s website, social media, or promotional materials is for reference only. The contracting process begins when THE CLIENT requests a quote for a specific service. THE AGENCY will then send a formal quote detailing the itinerary, inclusions, price, and terms. This quote will have a limited validity period as indicated therein.

3.2 Booking Confirmation A reservation is considered officially confirmed only when the following conditions are met:

FIRST: Confirmation is issued once the online booking request is processed and a security deposit or full payment is received within the established timeframes.

SECOND: THE PASSENGER must pay the remaining balance upon arrival in Peru. This can be paid in cash or by credit card (credit card payments are subject to an 8% surcharge). All transaction fees related to the security deposit must be covered entirely by THE PASSENGER.

Payments made without sending the corresponding receipt or without receiving official confirmation from THE AGENCY do not guarantee a reservation.

3.3 Passenger Information It is THE CLIENT’s sole responsibility to provide accurate and complete information for all passengers. Names must exactly match official ID documents or passports. Any errors leading to additional costs for modifications or ticket re-issuance (especially for trains or entry tickets) will be borne entirely by THE CLIENT. All tickets are personal, non-transferable, non-endorsable, and non-refundable.

4. PRICING AND PAYMENT POLICIES

4.1 Currency and Rates Rates may be quoted in US Dollars (USD) or Peruvian Soles (PEN). For payments in local currency, the exchange rate will be determined by THE AGENCY based on current market rates. Prices are subject to change without notice until the booking is confirmed by payment.

4.2 Taxes (VAT/IGV) Rates are expressed in USD or PEN and do not include the 18% VAT (IGV) applicable to Peruvians and residents. Foreigners are exempt from this tax; however, under Peruvian law (Legislative Decree No. 919), they must present their original passport and a valid migration card to qualify for the exemption. Otherwise, the tax will be applied to the total value.

4.3 Payment Methods and Fees THE AGENCY accepts bank transfers, deposits, credit/debit cards, PayPal, Western Union, and other international methods. All banking commissions, transfer fees, or payment platform surcharges must be covered by THE CLIENT. THE AGENCY must receive the exact net amount agreed upon in the quote.

5. CANCELLATION POLICIES

Once THE PASSENGER has paid the deposit, THE AGENCY proceeds to purchase tickets (such as Machu Picchu), which are issued automatically by the Ministry of Culture. These tickets are non-changeable and non-refundable.

  • Modifications requested 30 days or less before the start date will incur a 100% penalty.

  • Failure to show up at the scheduled time (No Show) incurs a 100% penalty.

  • Cancellations made 40 days or more in advance will incur an administrative fee of 30 Soles per passenger.

  • No refunds are provided if a passenger decides to discontinue a service mid-tour.

5.1 Flexible Services For standard tours (City Tour, Sacred Valley, Maras Moray, Rainbow Mountain, Humantay Lake):

  • Cancellations 30+ days in advance: 90% refund (10% administrative fee).

  • Cancellations 15–29 days in advance: 30% penalty of the total cost.

  • Cancellations 7–14 days in advance: 50% penalty of the total cost.

  • Cancellations less than 7 days in advance: Non-refundable.

5.2 Non-Refundable Services Certain services, such as Machu Picchu entry tickets, Inca Trail permits, train tickets (Peru Rail/Inca Rail), airfare, and Huayna Picchu/Machu Picchu Mountain permits, are strictly non-refundable and non-changeable once purchased.

5.3 No Show Policy Failure to arrive at the designated time and place results in a NO SHOW status and the loss of 100% of the service value. No refunds or rescheduling will be granted. Any additional costs resulting from delays (lost flights/trains) are the passenger’s responsibility.

6. MODIFICATIONS AND UNFORESEEN EVENTS (FORCE MAJEURE)

THE AGENCY reserves the right to modify itineraries, schedules, transport, or hotels when necessary to ensure passenger safety. In cases of Force Majeure (strikes, weather, social unrest), THE AGENCY will make every effort to reschedule or offer alternatives. If rescheduling is impossible, a partial refund may be issued, minus administrative fees and non-refundable provider costs. THE AGENCY is not liable for personal expenses arising from these delays (extra hotel nights, lost flights, etc.).

7. PASSENGER RESPONSIBILITIES AND OBLIGATIONS

The passenger declares they are in good physical and mental health to participate in the activities. Relevant medical conditions must be disclosed in advance. For high-altitude tours (above 3,000m), the passenger assumes all associated risks. Passengers must carry valid ID/passports at all times. THE AGENCY is not responsible for lost, stolen, or damaged personal belongings unless they were formally placed under our custody. Passengers must follow the guide’s instructions; inappropriate behavior may lead to removal from the tour without a refund.

8. INTELLECTUAL PROPERTY

All content on https://andeanmoments.com/, social media, and promotional materials (text, photos, itineraries, logos) is protected by intellectual property laws. Any reproduction or commercial use without express written authorization from ANDEAN MOMENTS PERU E.I.R.L. is strictly prohibited.

9. GOVERNING LAW AND DISPUTE RESOLUTION

This contract is governed by the laws of the Republic of Peru. Any disputes arising from this contract that cannot be resolved through direct negotiation will be submitted to the jurisdiction of the Courts of the Judicial District of Cusco.

By making a payment or booking a service, THE CLIENT declares they have read, understood, and fully accepted these Terms and Conditions.
